Plan de urgencia sobre cláusulas suelo: juzgados especializados

El Consejo General del Poder Judicial abordará con el Ministerio de Justicia la dotación de medios materiales y personales de los Juzgados de Primera Instancia para acometer el plan de urgencia previsto tras la reciente STJUE de 21 de diciembre de 2016 sobre la retroactividad de la declaración de nulidad de las cláusulas suelo, que hace previsible un aumento sin precedentes del número de litigios. El plan contempla la especialización de un Juzgado de Primera Instancia en cada provincia, con competencia extendida a todo su territorio, para conocer de la materia relativa a las acciones individuales previstas en la legislación de condiciones generales de la contratación y la protección de los consumidores y usuarios.
El CGPJ considera, según comunicado de 15 de febrero de 2017, que el plan debería ponerse en marcaba el próximo 1 de junio, de modo que los Juzgados especializados puedan asumir las demandas que se produzcan una vez concluidos los cuatro meses que suman los plazos establecidos en el Real Decreto-ley 1/2017 para que las entidades de crédito adopten las medidas necesarias para dar cumplimiento a sus previsiones y para que el consumidor y la entidad lleguen a un acuerdo o se tenga por concluido el procedimiento extrajudicial.
